  1. SERVICES

Phillip.Photography agrees to provide photography services for the Client/team on the agreed session date, time, and location. Services may include, but are not limited to, the following:

​

  • Individual player headshots

  • Individual basketball portraits consisting of 2–3 poses of each athlete

  • Professionally edited digital images per player

  • Team photo

  • Team sessions

  • Lifestyle pictures

  • Event photos

  • Game sessions of individual players

  • Individual portraits

​

Service descriptions are as follows:

​

a. Team Sessions
Team sessions may include posed team photographs, small group photos, player pairings, and candid team images, based on the Client’s needs and the time available.

​

b. Lifestyle Pictures
Lifestyle pictures may include natural, candid, and creatively directed images of players, coaches, or teams in a relaxed or storytelling style. These may be taken on the court, in the gym, outdoors, or at another approved location.

​

c. Event Photos
Event photos may include coverage of team-related events such as media day, senior night, banquets, signings, award ceremonies, camps, or other organized activities. Coverage includes candid and posed images as time permits.

​

d. Game Sessions of Individual Players
Game sessions for individual players may include action shots, sideline moments, warmups, and candid in-game coverage of specifically designated athletes. Client understands that final image quantity may vary depending on playing time, gym rules, lighting, crowd conditions, and the flow of the game.

​

e. Individual Portraits
Individual portraits may include posed images of one athlete or person, with or without sports equipment, and may be photographed in a studio-style, on-location, or environmental setting.

​

f. Standard Team Media Day Coverage
Unless otherwise agreed in writing, standard team media day services include:

  • Individual player headshots

  • Individual basketball portraits consisting of 2–3 poses of each athlete, up to 10 athletes maximum unless otherwise agreed

  • Professionally edited digital images per player

  • One team photo

g. Delivery
Unless otherwise agreed in writing, final edited digital images from any of the above services will be delivered digitally within 7–14 business days after the session and after all outstanding balances have been paid in full.

​

Specific deliverables, athlete count, event duration, game coverage period, and any custom requests must be agreed upon in writing before the session date.

​

FEES AND PAYMENT

Travel Fee: $200

The $200 travel fee will be waived if the team guarantees at least five (5) individual player package purchases.

To secure the session date, Client must choose one of the following:

​

Option A: Pay a non-refundable deposit equal to 50% of the travel fee ($100)

OR

Option B: Have at least five (5) participating persons complete the Individual/Player Package Intake Form, with a non-refundable $20 deposit paid at the time each form is submitted

​

All deposits are non-refundable. Any remaining balance is due on the day of the session.

​

If the team does not ultimately meet the minimum of five (5) individual player package purchases, the $200 travel fee shall apply.

​

REFUNDS

Refunds will only be issued in the event of photographer failure, including but not limited to the Photographer’s inability to perform the services or failure to deliver the agreed final images. No other refunds will be issued.

​

CLIENT RESPONSIBILITIES

Client agrees to the following:

  • The team and participating players will arrive on time

  • All players will be in full uniform

  • Players will bring any requested equipment or props needed for the session

  • A team representative will assist with organizing players and maintaining readiness

  • The Client will ensure access to the agreed location and any necessary permissions

Client understands that delays, tardiness, missing equipment, uncooperative participants, or lack of readiness may reduce shooting time and may limit the number or variety of images captured.

​

RESCHEDULING AND CANCELLATION

If the session must be rescheduled due to weather, unsafe conditions, or facility-related issues, both parties will work together in good faith to select a new date.

​

If Client cancels the session, any deposit paid will be forfeited unless otherwise agreed in writing by Phillip.Photography.

If Photographer must cancel due to emergency, illness, or other reasonable cause, Photographer will make reasonable efforts to reschedule the session. If rescheduling is not possible, any amounts paid by Client, excluding completed individual package services already rendered, shall be refunded.

IMAGE DELIVERY

Final edited digital images will be delivered electronically within 7–14 business days after the session, provided that all balances are paid in full.

COPYRIGHT AND IMAGE RIGHTS

All photographs taken by Phillip.Photography remain the sole copyrighted property of Phillip.Photography.

The team and individual players are granted a personal-use license to download, share, and print the images for personal, non-commercial use only.

​

Without prior written permission from Phillip.Photography, the following are prohibited:

  • Resale of images

  • Commercial use of images

  • Editing, altering, or applying filters to images

  • Use of images for merchandise, promotional materials, advertisements, or third-party publications

  • ​

Phillip.Photography reserves the right to use the images for portfolio purposes, website display, marketing, advertising, and social media.

​

LIMITATION OF LIABILITY

Phillip.Photography shall not be liable for delays, cancellations, or failure to perform caused by circumstances beyond reasonable control, including but not limited to weather, illness, venue restrictions, acts of God, equipment malfunction despite reasonable precautions, or other unforeseen events.

​

In any event, Photographer’s total liability under this Agreement shall be limited to the total amount paid by Client under this Agreement.

​

ENTIRE AGREEMENT

This Agreement constitutes the entire understanding between the parties and supersedes all prior discussions, understandings, or agreements, whether written or oral.

Any amendments or changes to this Agreement must be made in writing and signed by both parties.

​

GOVERNING LAW

This Agreement shall be governed by and interpreted in accordance with the laws of the State of Georgia.

​

ACCEPTANCE AND SIGNATURES

By signing below or acknowledgment by checkmark on previous page, both parties acknowledge that they have read, understood, and agreed to the terms of this Agreement.
